Motorists will be able to accelerate past the speed limit to pass slower drivers if a new bill is signed into law in the Wyoming Legislature.
House Bill 21 would allow drivers on roads with speed limits of 50 mph or greater to pass slower-moving vehicles. The proposed law would allow the motorist passing in the left lane to go up to 10 miles over the speed limit to pass, but only if the other motorist is going below the speed limit. The passing motorist must return to the right lane and drop down to the speed limit as soon as safely possible.
Ernest Johnson, criminal justice professor at the University of Wyoming and a former law enforcement officer, said he could understand the legislative intent.
He said the part of the bill which says passing vehicles must return to the right lane safely makes a lot of sense. Johnson said he hoped motorists would not use the law as an excuse to exceed the speed limit when they do not need to.
Johnson said that while increasing the speed limit temporarily will not increase crime, the potential for accidents is greater. Based on analysis and research into traffic crashes and death, driving at faster speeds can make it harder to avoid crashes, he said. Johnson added that it could result in more serious injuries or death if a crash does occur at higher speeds.
The bill does not say how law enforcement officers will carry out the law. The bill only states the passing motorist cannot be above the 10 mph allowance, and does not mention if law enforcement would have to check speeds on both vehicles. Johnson said law enforcers would have to use their best judgment and assess the proximity and speed of nearby vehicles.
The proposed law also lists exceptions. Motorists cannot go beyond the speed limit to pass in a construction zone. The bill also states drivers towing anything behind their vehicle cannot go over the speed limit to pass the slower drivers. The bill only applies to two-lane roads.
The bill, which is sponsored by Rep. Del McOmie of House District 54, succeeded in passing the last vote in its final reading, with 53 voting in favor and none against. The Senate President signed the bill into House Enrolled Act 31, which means both the Senate and House approve of the bill. The bill will become law if Gov. Matt Mead signs it.
